Nanavati-Shah Commission is Modi’s Operation Whitewash
New Delhi: Syed Shahabuddin, president of the All India Muslim Majlis-e-Mushawarat (AIMMM), issued the following Statement on 11 June:
"The All India Muslim Majlis-e-Mushawarat (AIMMM) has noted with regret and dismay that the Government of Gujarat has disregarded the universal demand, supported by nearly all NGO’s of national eminence, political parties as well as Muslim organizations, for replacing the Shah Commission of Inquiry with a new Commission consisting of a sitting Judge of the Supreme Court and 2 sitting Judges of the High Court to inquire into the facts and circumstances leading to the unprecedented genocidal massacres in Gujarat, with comprehensive terms of reference.
The Government of Gujarat has responded by adding a retired judge of the Supreme Court. The Nanavati-Shah Commission does not meet the requirements of the situation nor does it inspire confidence, because the judges have been handpicked by the Chief Minister who stand accused of complicity in the carnage before the bar of national and international opinion. Neither have the terms of reference been revised and their focus still is on Godhra incident and not on the entire sequence of genocidal carnage in Gujarat in which allegedly more than 2000 lives have been lost.
The Commission of Inquiry, as it stands, has been constituted not with a view to find the truth but to whitewash and cover up the crimes against humanity perpetrated with the connivance and support of Chief Minister Modi, his government and his administration.
In the circumstances, the AIMMM has no option but to advise the Muslim community of Gujarat and the NGOs working for them to boycott the Nanavati-Shah Commission of Inquiry.
The AIMMM places on record that the State Government already stands indicted by the National Human Rights Commission in its Report of 31 May, 2002 which is headed by a former Chief Justice of India and includes 2 former Judges of the Supreme Court and which, therefore, commands a much higher status and enjoys much higher esteem in the eyes of the people, than a Commission consisting of 2 judges handpicked by a Chief Minister.
The AIMMM appeals to the Government of India to exercise its power of intervention under Article 355 of the Constitution and direct the State Government to cancel the appointment of the Nanavati-Shah Commission and appoint a Commission of Inquiry, as desired by the people and approach the Chief justices of the Supreme Court and of the High Court concerned to nominate the judges of their choice."
