Home Minister’s Refusal of Inquiry by Sitting Supreme Court Judge Legally, Constitutionally and Morally Untenable

Nothing More than a Ploy to Protect Modi Government

New Delhi, 25 April, 2002
: Shri Syed Shahabuddin, President of the All India Muslim Majlis-e-Mushawarat (AIMMM), has issued the following Statement:

"In his statement in the Rajya Sabha on 24 April, 2002, Shri L.K. Advani, Home Minister has tried to mislead the public opinion by speaking of a second inquiry by the Union Government.

No one has asked for a parallel investigation by a Commission of Inquiry appointed by the Central Government.

The universal demand is for the cancellation of the Shah Commission of Inquiry appointed by the State Government because it does not command the confidence of the people. In any case, it has not even begun its work.

A Commission of Inquiry consisting of one sitting judge of the Supreme Court and two sitting judges of the High Court with appropriate terms of reference, can then be appointed either by the State Government, or if there is a technical hitch, by the Union Government, with the consent of the State Government.

Thus, the point-blank and summary rejection of the demand for a new Commission of Inquiry has no legal, constitutional or moral justification. It is no more than a ploy to protect the Modi Government."
