Mushawarat Denounces Loot of Prime Land by Sangh Parivar Allotment of Land Without Notifying Eligibility and Procedure and Without Public Notice is Unconstitutional
Demands Cancellation of All Allotments under NDA and Invitation to all Eligible Institutions to apply
New Delhi, 17 August, 2002: Shri Syed Shahabuddin, President of the All India Muslim Majlis-e-Mushawarat
(AIMMM), has issued the following Statement:
"The AIMMM condemns the loot of prime land in the capital territory of Delhi by the Sangh Parivar with the connivance and support of the NDA Government in the name of some fictitious institutions and organizations and some societies registered just before the allotment.
The AIMMM notes that the Ministry of Urban Development has abolished the Land Allotment Committee and thus set into motion arbitrary allotments under the direct control of the successive ministers concerned, who have been acolytes of or close to the Sangh
Parivar.
The AIMMM notes with regret that the LDO of the Ministry of Urban Development and the DDA have almost exclusively allotted land to Hindu bodies, including temples, to the almost total exclusion of Muslim or Christian bodies or Masjid and Churches. Indeed even Muslim concentration areas have been refused allotment of land for mosques,
madarsas, Muslim-run schools and Qabristans. Such religious discrimination is blatantly unconstitutional.
The AIMMM has also taken note of the fact that the Government or the DDA have not published the criteria or the procedure laid down for land allotment. Nor have they ever invited applications through public notice for allotment of land from desirous and eligible institutions, organizations and societies. This makes the allotments a private transaction between the organizations floated by the Sangh Parivar or favoured by its activists, on one hand, and its patrons in the government and the ever obliging officialdom, on the other. Denial of equality of opportunity is equally unconstitutional.
The AIMMM demands the cancellation of all allotments since the NDA came to power, the reestablishment of the Land Allotment Committee, the notification of the criteria for the allotment of land to private organizations in the capital territory and the procedure to be followed for the allotment of plots which have been developed for institutional purposes on concessional rates as well as strict compliance with the procedure in all future allotments."
