Venkaiah Naidu Displays Legal Ignorance by Describing ASI Report as Conclusive or Ultimate Evidence for VHP’s Case
VHP and BJP should Now Commit
Themselves to Accept Judicial Verdict
New Delhi, 29 August, 2003: Shri Syed Shahabuddin, President of the All India Muslim Majlis-e-Mushawarat (AIMMM), has issued the following Statement:
"The BJP President Shri M. Venkaiah Naidu has stated at his Press Conference in New Delhi on 27 August, 2003 that the ASI report is ‘conclusive’ and ‘ultimate evidence’ in support of the contention that the "Babari Masjid was constructed in 1528 on the site of a grand 10th century temple ….. after demolishing the temple."
Shri Naidu is intelligent enough to appreciate the legal status of the Report. It is nothing more than a piece of expert evidence tendered to the Court which shall be considered by it in the light of the comments by the parties to the title suit under hearing and perhaps additional expert evidences tendered by them. Then the Special Bench will assign the proper value and weightage to the Report and consider it alongwith other pieces of evidence before it, now or in future, on the specific issue which is only one out of 20 odd issues to be decided.
However, if Shri Naidu really thinks that this inspired Report by a subservient department of the Union Government gives him the master key to secure a favourable judicial verdict, why should he or his friends in the VHP go on repeating the plea for negotiations for an out-of-court settlement or for legislation? They should accept the jurisdiction of the court and commit themselves to accept the final judicial verdict.
