MEETING OF THE MARKAZI MAJLIS-E-MUSHAWARAT
NEW DELHI, 11 OCTOBER, 2003
RESOLUTIONS ON NATIONAL AND INTERNATIONAL QUESTIONS

RESOLUTION 11/1: ON Elections under the Dastoor
The Markazi Majlis-e-Mushawarat,
Endorses the appointment of Mr. A.R. Shervani as the Returning Officer for the election of the President and the Members of the Markazi Majlis-e-Amla for the period 2004-2007 as well as the proposed modalities as well as the draft Schedule for the Election published on 8 September, 2003;
Calls upon all members, Jamaats and individuals, in arrears of membership fee for the period 2000-2003 against them to pay the dues by 7 December, 2003 so that their names maybe included by the Central Office in the Electoral Roll.
Invites all the former members of the MMM, who are eligible under the Dastoor for the membership of the Markazi Majlis-e-Mushawarat, to enroll themselves for the term 2004-2007 by filling the prescribed form and paying the annual fee for the year 2004 by 7 December, 2003; and
Requests the President to redouble his efforts to enroll as many important Jamaats and eminent individuals as possible in accordance with the Dastoor.

RESOLUTION 11/2: ON CONSOLIDATION OF SECULAR FORCES
The Markazi Majlis-e-Mushawarat,
Convinced of the urgent need for alliance, understanding and adjustment among secular parties in the coming State elections to avoid the division of secular votes;
Reiterates its call to the secular political parties to bury their differences and accommodate each other to give a one-to-one fight to the forces of communalism and chauvinism;
Opposes the move for a Third Front based on ill-conceived equidistance between the INC and the BJP and hopes that the Third Front, when formed, shall nevertheless become a part of a National Secular Alliance; and
Cautions the Muslim community against the game of the Sangh Parivar to set up political formations to divide the Muslim votes and thus to undermine their political weight in the coming elections and pave the way for the defeat of the winning secular party.

RESOLUTION 11/3: ON Developments in UP
The Markazi Majlis-e-Mushawarat,
Welcoming the formation of the new Government in UP under the leadership of Shri Mulayam Singh Yadav; 
Expresses the hope that his Government shall move expeditiously to remove the longstanding grievances of the Muslim community, particularly in the field of education and public employment, take all possible steps to re-establish an environment of peace, goodwill and fraternity in the State and deal effectively with the forces which promote hatred and hostility.

RESOLUTION 11/4: ON BABARI MASJID QUESTION
(A) The Markazi Majlis-e-Mushawarat,
Conscious of the near universal criticism of the ASI’s Report on Excavation in Ayodhya by eminent archaeologists and historians; 
Notes that the final conclusion of the Report does not support the contention that a standing Ram Temple was demolished in 1528 to build the Babari Masjid in its place and on the other hand, the excavation throws up the possibility of the construction of a Masjid during the period of Muslim settlement in Ayodhya beginning from the 12th century;
Expresses the hope that the inherent methodological flaws of the Report and its contradictions and fallacies and its unsupported conclusions shall be fully exposed in the course of its examination by the Special Bench of the Allahabad High Court; and
(B) The Markazi Majlis-e-Mushawarat,
Noting with regret the discharge of Shri L.K. Advani by the Special CBI Court at Rae Bareli;
Calls upon the Government of UP and the CBI to appeal against the discharge and to oppose the review petitions filed by those charged in the High Court; and
Also requests the Government of UP immediately to revise the original Notification as suggested by the Allahabad High Court so that all the FIR’s relating to the Demolition filed by the CBI and the consequent chargesheets are judicially processed by the same Special Court.
(C) The Markazi Majlis-e-Mushawarat,
Taking note of the plans of the VHP to stir the cauldron of agitation on the Mandir question again and of the growing opposition of the citizens of Ayodhya to the VHP’s endeavour to keep the town in a state of tension;
Cautions the Government of UP and the Union Government against the inherent threat of violence by the Ram Sevaks in Ayodhya and en route from Delhi to Ayodhya; and 
Requests the Government of UP to maintain law and order and to videotape the public events and the speeches by the VHP leaders along the entire route for possible legal action.

RESOLUTION 11/5: ON Kashmir Question
The Markazi Majlis-e-Mushawarat,
Taking nof the Consensus Statement issued by the National Convention of Indian Muslims on Jammu and Kashmir, held in New Delhi on 21 September, 2003 and its emphasis on the historic links and interdependence between the Muslims of Jammu and Kashmir and the Muslims in the rest of the country;
Reiterates its hope for an end to violence in the Valley and early resumption of dialogue between the Government and all shades of political opinion in the State on the implementation of the Resolution of the J&K Assembly for restoration of full autonomy to the State; and
Also supports bilateral talks without any pre-conditions between India and Pakistan for a final settlement of the problem in the larger common interest of the States and peoples of South Asia.

RESOLUTION 11/6 ON TERRORISM
The Markazi Majlis-e-Mushawarat,
Taking note of the series of bombings in Mumbai culminating in the bomb blasts on 25 August, 2003, which have been attributed by the authorities to members of the Muslim community, without full investigation;
Recalling the saffron terrorism resulting in genocidal carnage and forcible exile and expulsion of Muslim inhabitants from their homes in Gujarat and beyond;
Recalling also the repeated threat by the VHP leaders to enact Gujarats all over the country;
Convinced that terrorism can be countered only, by effective steps to curb those organizations which use terrorism to achieve political ends, stop propaganda against any group, restore the rule of law and assure justice to the victims through punishment of the culprits;
Condemns terrorism in all its forms and manifestations and declares it contrary to Islam and a violation of human rights;
Considers that acts of terrorism by individuals should not be exploited to inflame public opinion against communities or social groups to which they belong;
Cautions the Muslim community against agents provocateur as well as misguided extremists who incite Muslim youth to engage in acts of violence in revenge and retaliation.
Demands a ban on all Senas and other militant organizations which give military training, preach hatred and revenge and incite suspicion and violence against other sections of the people; and
Protests against the indiscriminate use of POTA by some State Governments, particularly against the Muslim youth in Gujarat, Maharashtra, AP and Tamil Nadu.

RESOLUTION 11/7: ON Reservation
The Markazi Majlis-e-Mushawarat,
Noting the general national consensus in favour of reservation in public employment for the economically backward classes; 
Proposes that the system of reservation should be rationalized, on the basis of common criteria of economic, educational and social backwardness and uniform parameters to measure the overall level of backwardness and that reservation should be universalised to cover all identifiable social groups, and sub-groups with a reasonable share in population with separate reservation quotas for each on the basis of the product of population and level of backwardness;
Also proposes an amendment to the Constitution to nullify the existing arbitrary limit of 50% on reservation, because of the wide variation in social demography and total quantum of backwardness from state to state; and
Authorizes the President to place the case for a separate quota for the Muslim community or for various Muslim sub-communities before the competent authorities.

RESOLUTION 11/8: ON Protected Masjids
The Markazi Majlis-e-Mushawarat,
Taking note of the recommendation of the JPC on the Functioning of the Wakf Boards for the restoration of Protected Masjids to the State Wakf Boards for their proper maintenance, in view of the persistent and deliberate inattention by the ASI and its failure even to protect then physically and repair, maintain and conserve them; and
Demands the urgent implementation of this important recommendation and calls upon all State Wakf Boards immeidately to undertake a physical survey of the Protected Masjids in their jurisdiction.

RESOLUTION 11/9: ON Punjab Wakf Board
The Markazi Majlis-e-Mushawarat,
Noting the trifurcation of the Punjab Wakf Board by the Government of India by the Gazette Notification of 9 August, 2003 behind the back of the Muslim community;
Apprehending that the small Muslim communities in Punjab, Himachal Pradesh and Haryana shall not be able to protect the Wakf estates against unlawful occupation and usurpation, plunder and aggrandizement;
Considering that the formation of viable Wakf Boards in these States in accordance with the Wakf Act, 1995 may be well-nigh impossible; 
Appeals to the Union Government and the State Governments concerned to review the decision which may only benefit the dominant political class to the detriment of the community;
Calls upon the Central Wakf Council to intervene urgently and to establish a suitable mechanism to monitor the situation closely; and 
Reiterates its call on the Muslim communities and organizations in Haryana, Punjab and H.P. to form Wakf Protection Committees at district and state levels.

RESOLUTION 11/10: ON IRAQ SITUATION
The Markazi Majlis-e-Mushawarat,
Noting the intention of the USA to keep Iraq under indefinite occupation in order to exploit its oil resources and to maintain a decisive military presence in the region to serve its geopolitical interests; 
Calls upon the international community to exert pressure on the occupying powers to withdraw from Iraq and transfer power to the interim political authority which should report directly to the UN Security Council and proceed with the task of national reconstruction with international assistance; and 
Cautions the international community against extending any support or assistance to the USA and other occupying powers, either in the form of men or money, unless they announce a date for military withdrawal from Iraq and for transfer of power to the interim national authority and agree to full UN control of the proposed international peace keeping force of the political process and of the international participation in economic reconstruction.

RESOLUTION 11/11: ON PALESTINE
The Markazi Majlis-e-Mushawarat,
Considering the Israel’s standing threat to ‘remove’ Yasser Arafat as barbaric and negation of the right of the Palestinian people to have a leadership and a government of their choice, and as a defiance of the will of the UN and a threat to world peace;
Convinced that the existence and expansion of Jewish settlements in the West Bank and the construction of security walls by Israel on Palestinian land to protect them are the biggest obstacles in the path of just and durable peace;
Convinced also that Israeli expansionism coupled with international insensitivity leaves no option for the Palestinians but to resist the Israeli occupation, acts of terrorism and oppression with all possible means to defend their homeland and their life and honour;
Noting that the Israel derives its will and energy to defy the world opinion and oppress the Palestinian people because of the total support extended by the US, out of domestic political compulsions, even at terrible cost to its prestige and standing in the rest of the world;
Deplores the official visit by Prime Minister Sharon of Israel to India for consolidation of relations with that terrorist State in the present circumstances as a betrayal of the basic principles of India’s foreign policy; and
Demands that the international community take effective steps to force Israel to vacate the Arab Occupied Territories and as a first step, to dismantle the Jewish settlements, the security walls and military posts therein and interpose an international force between them for mutual security. 

RESOLUTION 11/12: ON CHECHNYA
The Markazi Majlis-e-Mushawarat,
Noting the state-managed Presidential election held by Russia in Chechnya on 6 October, 2003;
Expresses its conviction that election will not deceive the world opinion, nor affect the course of the freedom struggle;
Deplores the fact that Russia has reneged on the Agreement of 1994 and unilaterally repudiated the elected President and continues to wage high-tech war against the Chechen people;
Regrets the silence of the international community, specially the European Union on this blatant violation of human rights and of Constitutional and legal proprieties; and
Appeals to the international community to intervene effectively to stop further bloodshed and bring about a political settlement."
