AIMMM and BMMCC Urge U.P. Government to Replace Entire Counter-Affidavit by Another
UP Counter-Affidavit Reads Like Defence of CBI and Mayawati, Contrary to CM’s Public Stand
New Delhi, 18 November, 2003: Shri Syed Shahabuddin, President of the All India Muslim Majlis-e-Mushawarat
(AIMMM), Convenor, Babari Masjid Movement Coordination Committee, has issued the following Statement:
"The All India Muslim Majlis-e-Mushawarat (AIMMM) and the Babari Masjid Movement Coordination Committee (BMMCC) are shocked and pained by the counter-affidavit filed by the State of Uttar Pradesh in the Writ Petition filed by Mr. Wajahat Ansari pleading for the nullification of the amended charge-sheet filed by the CBI in the Babari Masjid Demolition Case and for the transfer of the case back to
Lucknow.
The UP Counter-affidavit reads as a total reversal of the stand taken, in the Parliament and outside, by Shri Mulayam Singh Yadav, now the Chief Minister of U.P. when he had accused the CBI of acting under pressure of the Union Government and diluting the chargesheet 198/92 in order to protect Shri L.K. Advani and other leaders of the BJP and VHP who were earlier charged with conspiracy.
The affidavit reads like a defence of the CBI. This should have been left to the CBI.
The affidavit also endorses the stand taken by the UP Government when Ms. Mayawati was the Chief Minister on the need and propriety of the trial being shifted to Rae
Bareli.
The AIMMM and the BMMCC request the Government of UP and Shri Mulayam Singh Yadav, Chief Minister, to withdraw the entire counter-affidavit and to substitute it by another counter-affidavit which would reflect his public stand, particularly on:
a) the propriety of the conspiracy charge against Shri L.K. Advani etc.
b) the impropriety of the diluted charge-sheet filed by the CBI;
c) the impropriety of shifting the case to Rae Bareli.
