Miserable plight of Muslim under-trial detainies in Tamil Nadu
Memorandum submitted to the hon'ble chief minister of Tamilnadu
Chennai, 29 August, 2005:
Respected Madam,
At the outset, we wish to make it clear that we do not like to interfere with the prescribed normal process of law by which hundreds of Muslims have been detained in the various jails in the State and are being tried in criminal courts since an extremely long time. The period of their detention is much longer than what would have been awarded to them if they had been found guilty. This is, not only tragic, but also beyond the canons of justice. Besides, it must be noted that the conditions which prevailed and which prompted the detainies to commit criminal acts (assuming they had really committed criminal acts) no longer exist now. We appeal to you to graciously pardon them by withdrawing the cases against them. In this connection, we wish to state that one of the top leaders of your own Party-in-Power and former Chief Minister Thiru O. Paneerselvam is reported to have declared that there is no "Muslim terrorism" in the state. The withdrawal of cases against these unfortunate detainies will help them to turn a new leaf and join the national mainstream as good, law-abiding and useful citizens.
We, further, humbly, submit that, our knowledge, those who are sentenced to "life imprisonment" in the neighbouring States are let off after about ten years but it is not being done so in our State. Kindly look into the matter and do the needful.
We fervently hope that you will bestow your personal attention and take a magnanimous decision, for which act of grace, our Katchi, the said under-trials and prisoners, their kith and kin, the entire Muslim minority community and all human rights activists will be very much beholden to you and it will, certainly, enhance your popularity amongst the masses.
