Hanging of Yaqub Memon is murder of justice: Indian Muslim Mushawarat


New Delhi, 21 July, 2015: “Hanging of Yaqub Memon before justice is done to the victims of the post-Babri demolition riots of Bombay in December 1992 and January 1993 is murder of justice, said Dr Zafarul-Islam Khan, President of All India Muslim Majlis-e Mushawarat, the umbrella body of Indian Muslim organisations and eminent personalities.

Dr. Khan said there are many mitigating factors in Yaqub Memon’s case. He was not found involved in planting or exploding bombs, there is no material evidence against him as he is convicted on the basis of someone else’s “confession”. Moreover, he voluntarily returned to the country surrendered to the Indian authorities.

In contrast, Dr Khan said, murderers, killers, rapists and plunderers of the post-Babri riots of December 1992 and January 1993 roam scot-free despite all the evidence piled up against them in Srikishna Commission’s report, submitted way back in February 1998. Both Shiv Sena leaders as well as police officers energetically participated in those gruesome riots in which 900 persons were killed including 575 Muslims.

Srikishna report, which named 31 police officers for their lapses or provocative role in the riots, described the police behaviour during those events as one “not befitting the police force of any civilised democratic state.” Yet nothing happened to the Shiv Sena goons or police officers while the State went out of its way to search and punish those who had retaliated against the Bombay riots. Both are guilty but those who are entrusted with the maintenance of law and order and those who take the oath to uphold the Constitution must be punished first and more severely. Unless this happens, Yaqub and his ilk’s execution will remain judicial murder by a callous political system which believes in offering human sacrifices from time to time in the false belief that this will prolong the life of this unjust system where minorities and marginalised sections have no right to justice.
